On November 29, 2002 The Associated Press reported that "the Supreme Court late Friday upheld a federal judge's ruling that the city of Cincinnati cannot bar a Jewish organization from displaying a menorah on a downtown plaza during the holidays. The court lifted a stay by the 6th U.S. Circuit Court of Appeals, noting the city square's historic character as a public forum. Over the city's objections, the Klan in the 1990s won rulings in federal courts entitling them to erect crosses on Fountain Square. An American Civil Liberties Union lawyer representing the Klan argued that since the menorah was allowed, the city couldn't discriminate against the free-speech rights of other organizations to use the square. Protesters toppled the 10-foot crosses several times. The city eventually assigned extra police to protect the displays and quell demonstrations."
