A federal judge ruled Friday that a 5-year-old Needville Elementary School kindergartner will be allowed to return to school with his hair in plain sight, at least for now.
The American Civil Liberties Union of Texas filed a federal lawsuit on behalf of a Native American student, Adriel Arocha. He was taught separately from his classmates by a teacher in one-on-one setting because he had not complied with a dress code exemption the school board granted him in August concerning his long hair.
He was to wear his long hair in a single braid and tuck it under his shirt when he attended school. But he refused to comply, wearing his hair in two braids outside his shirt.
During a hearing Friday, U.S. District Judge Keith Ellison granted the family's request that the boy be returned to join his schoolmates and that he wear his hair outside his shirt for now. Another hearing on the case is scheduled for Friday.
